Terms of Service
Last updated October 28, 2026
Talking Pumpkin ("the service", "we") is run by Nikita Zdvijkov, a sole proprietorship based in Houston, Texas, USA. By buying a pass or using the service you agree to these terms. Questions: halloween@pobox.com.
Who sells it
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's buyer terms also apply to your purchase.
The pass
- A pass costs $5 (plus tax where it applies), paid once. It is not a subscription and nothing renews.
- Every pass stops working at the end of November 5 2026 (Pacific time), however much talk time is left.
- A pass includes about 2½ hours of conversation. That figure is an estimate: the real amount depends on how long the pumpkin and its visitors talk. The page shows what is left.
- Your private link gives access to your pass. Keep it to yourself; anyone who has it can use your talk time.
- You must be 18 or older to buy a pass.
Using it
- The pumpkin's replies are generated by AI (OpenAI's Realtime API). They can be odd, wrong or unexpected. Don't rely on anything it says.
- The personality you write must not be used to harass, deceive or frighten anyone for real, to impersonate a real person, or to make the pumpkin say anything hateful, sexual, violent or illegal. Remember children may be talking to it. We may refuse a personality, and suspend a pass that is misused, without refund.
- You are responsible for where you set it up. The pumpkin listens to anyone near it while it is awake; let your guests know, for example with a small sign, and follow the rules of the place you put it.
- Don't try to get around the talk-time limit, copy the service, or use it for anything other than a talking decoration.
Refunds
See the refund policy: in short, a full refund within 14 days of purchase, for any reason.
No warranty
The service is provided "as is" and "as available". It depends on your device, your internet connection and services we don't control, and we don't promise it will work at every moment. To the extent the law allows, our total liability for anything to do with the service is limited to what you paid for your passes.
Changes and law
We may update these terms; the date above shows the latest version. These terms are governed by the laws of the State of Texas, USA, and any dispute will be handled in the courts of Harris County, Texas, unless the law where you live says otherwise.
